The applicants accuse the defendants of violating collective agreements ("CBAs") with the Union by failing to make the necessary contributions and by refusing to authorize the examination of their books. The management and members of Steamfitters Local 638 of the United Association of HVACR, Steamfitters, Pipe Fitters and Sprinkler Fitters welcome you on our new website. On our website, you will find a lot of information about our great local and international union. Here is an introduction to the benefits that HVACR service technicians get as members of the local union and the union membership process. The United Nations Association`s Local Steamfitters Association 638 was #3189 in 1884 as a knight of the company. In 1914, the Business Association`s Business Assembly was attached to the Business Association of the Steam Business Association, Hot Water Water, Sprinkler, Pneumatic Tube, Ice Machine and General Pipe Fitters of New York and Vicinity Local 638 and the Association Progress of Steam, Hot Water and General Pipe Fitters Helpers of New York and Vicinity Local 639. At the same time, a trade agreement was developed to establish jurisdiction between the Steamfitter and the plumber, commonly known as the 1914 agreement. The applicant parties argue that there is no jurisdiction for the object within the meaning of ERISA or LRMA, since they are in fact not parties to collective agreements with the Union.
This mixes the merits of the applicants` claims with the existence of jurisdiction. Steamfitters Local 638 is the New York subsidiary of AU, the union that represents workers in the hVACR industry. The jurisdiction of the local chapter is that of the five districts of New York and Long Island. Under the current collective agreement (which will remain in effect until June 2021), HlVACR service technicians who are members of Local 638 receive the following benefits and allowances: In the FCC`s tenth appeal, the applicants submit that hlSC entered into a letter in January 2013 relating to compliance with the Union`s conditions for HLSC for the construction of a particular project in Brooklyn, New York. The letter of compliance contained, by reference, the terms of a labour agreement between the Union and the New York State Workers` Association. In accordance with the letter of compliance and the work agreement, HLSC was required to make hourly contributions to the construction funds and LMCC for all construction work of its staff on the Brooklyn project. The applicants assert that HLSC did not provide $18,914.90 in necessary contributions, as calculated in Schedule 10 of the CAF, which breaks this amount by union member, month and category of ancillary benefits.
The applicants are the agents of two groups of trust funds for the employment services of several employers: the local pension funds of Metal Trades and the Service Fitters Industry Educational Funds ("Metal Trades Funds") and Steamfitters Industry Pension, Supplemental Retirement, Welfare, Educational, educational, and Security Benefit Funds and Vacation Plan ("Construction Funds").
