The applicants accuse the defendants of violating collective agreements ("CBAs") with the Union by failing to make the necessary contributions and by refusing to authorize the examination of their books. The letter of compliance contained, by reference, the terms of a labour agreement between the Union and the New York State Workers` Association. In accordance with the letter of compliance and the work agreement, HLSC was required to make hourly contributions to the construction funds and LMCC for all construction work of its staff on the Brooklyn project. The applicants assert that HLSC did not provide $18,914.90 in necessary contributions, as calculated in Schedule 10 of the CAF, which breaks this amount by union member, month and category of ancillary benefits.
