Look at tar 2401 registration agreement between broker and owner. This form allows a broker to register the buyer with the seller, and if the buyer buys the property, the seller pays the real estate agent. If the seller refuses to enter into a contract under TAR 2401 (or a similar contract), the broker should inform the buyer and seek further instructions. It may be necessary for the buyer to pay the broker directly, but seeks certain concessions for the buyer in the contract. The Residential Real Estate Listing Agreement, Exclusive Right to Sell, also provides for a period of protection. During this period, a broker may be entitled to compensation after the expiry of the reference contract if the broker informs the seller of the potential buyers for whom the property was retained during the reference period. If the seller agrees to sell the property to one of these interested parties during the period of protection, the broker will be entitled to the compensation he would have received at the end of the sale if the reference contract were still in force. The protection period does not apply when the seller has to conclude an exclusive listing contract a posteriori with another REALTOR® and the other realtor® have to pay for the sale of the property. 10. GLOBAL AGREEMENT: This Agreement defines the entire agreement and understanding between the Parties concerning the subject matter included therein and supersedes all prior discussions between the Parties. No modification or supplement to this Agreement or any waiver of the rights conferred by this Agreement shall be effective unless signed in writing by the party to be invoiced. Any subsequent modification or modification of the obligations or commissions of the agent shall not affect the validity or extent of this Agreement. 12.
